Casting of ashes
On 15 March 2011, Municipal Council Resolution No. 42 approved the municipal regulation “Custody, preservation and casting of ashes from the cremation of deceased persons”.
The regulation provides that in the Municipality of Venice ashes from cremation of the deceased may be scattered in the following places:

“Garden of Remembrance” located within the cemeteries of: San Michele in Isola, Mestre Centro, Marghera.

private area, in the open and outside the built-up area, having first obtained the consent of the owner, by filling in the following form: Declaration of consent of the owner of the area where the ashes will be scattered

in nature, and specifically in the following places: Bosco di Mestre (Zaher Woods area behind the memorial), Adriatic Sea 700 metres from the coast, North Lagoon: in the area behind the San Michele Cemetery on the south side.

To the relatives of the deceased.
What to do
-
submit the request for authorisation to scatter the ashes to the Civil Registry Office of the municipality where the ashes are kept by downloading the following form: Request for authorisation to scatter ashes

attach one of the following documents attesting to the expression of the deceased's will, and in particular:
-
testamentary disposition (public will/holograph published pursuant to Art. 606 of the Italian Civil Code);
-
membership, certified by the legal representative, of recognised associations having as one of their purposes the cremation of the corpses and the scattering of the ashes of their members;

declaration in lieu of affidavit made pursuant to Art. 47 of Presidential Decree No. 445/2000:
- in the presence of a will: the spouse or, failing that, the closest relative identified pursuant to Article 74 ff. of the Italian Civil Code, and in the case of several relatives of the same degree, unanimously declare the place where the deceased wished his or her ashes to be scattered, download form
- in the absence of a will: the next of kin, identified in accordance with Article 74 ff. of the Italian Civil Code, unanimously declare that they are aware that the deceased had expressed during his or her lifetime his or her wish for his or her ashes to be scattered, as well as the place of their scattering download form
In the case of scattering ashes of a foreign national, attach the following documents, translated into Italian and legalised or with apostille, to the application:
- death certificate
- record of cremation and delivery of ashes;
- testament, or alternatively, a sworn statement made by the spouse or legal relatives to the local authority of the State of the deceased's nationality indicating the degree of kinship, the deceased's wish for the scattering of his or her ashes with an indication of the place of casting and a certificate from the same authority of the State of the deceased's nationality stating that the scattering of the ashes is permitted.
For the ashes to be brought into Italy, it is necessary to be in possession of a transport authorisation issued by the competent Italian Consulate for the territory.
Authorisation is issued by the Civil Registry Office that carried out the proceedings, subject to an appointment.
During the preliminary investigation, the Civil Registrar, in addition to verifying the documentation and the legitimacy of the request, will inform the interested party of the arrangements for the payment of any fees, if due. Fees
To be transmitted to the Civil Registry Office within eight days of scattering of the ashes:

in the event of scattering in nature: the declaration of scattering

in case of scattering in the cemetery area: the report of scattering
The authorisation is collected, by appointment, at the Civil Registry Office that carried out the proceedings.
How much does it cost?
- Both the application and the authorisation are subject to stamp duty of €16.00.
- Possible payment of the scattering fee and the master of ceremonies service, to be paid in the manner communicated to the person concerned by the Civil Registry Office.
Quality standard
Time interval from registration of request to issue of authorisation <=30 days.
